This Acceptable Use Policy ("AUP") governs your use of VoiceCreator's services, platform, website, and mobile applications (collectively, the "Services") provided by Aetheron Global Pty Ltd ("VoiceCreator," "we," "our," or "us"). This AUP is incorporated by reference into our Terms of Use.
By accessing or using our Services, you agree to comply with this AUP. If you do not agree with this policy, please do not use our Services. We reserve the right to modify this AUP at any time by posting the changes on our website. Your continued use of the Services after any changes indicates your acceptance of the modified AUP.
2. Compliance with Laws and Regulations
You must use our Services in compliance with all applicable laws and regulations, including but not limited to:
- Australian federal, state, and territorial laws
- Privacy and data protection laws
- Intellectual property laws
- Telecommunications laws
- Consumer protection laws
- Laws regarding fraudulent, deceptive, or misleading conduct
- Anti-discrimination and human rights laws
- Laws regarding recording, monitoring, or intercepting communications
When using our Services in other jurisdictions, you must also comply with all applicable local laws and regulations in those jurisdictions.
3. Prohibited Uses
You agree not to use our Services to:
3.1 Illegal Activities
- Engage in any illegal activity or encourage others to engage in illegal activity
- Violate any applicable laws, regulations, or third-party rights
- Attempt to circumvent any legal restrictions through technical or other means
3.2 Harmful or Fraudulent Conduct
- Create or distribute malware, viruses, or other harmful code
- Engage in phishing, spoofing, or other fraudulent activities
- Impersonate others or misrepresent your affiliation with any person or entity
- Engage in activities that constitute or encourage identity theft
3.3 Unauthorised Access
- Gain or attempt to gain unauthorised access to any account, system, or network
- Interfere with the Services or servers or networks connected to the Services
- Circumvent any security measures we implement for our Services
- Probe, scan, or test the vulnerability of our systems or networks
- Breach or otherwise circumvent authentication or security measures
3.4 Abusive Content
Create, upload, or distribute content that:
- Is defamatory, abusive, harassing, or threatening
- Promotes discrimination, bigotry, racism, or hatred
- Is excessively violent or incites violence
- Contains sexually explicit material
- Is false, inaccurate, or misleading in a way that could cause harm
- Infringes on anyone's intellectual property rights
- Violates anyone's privacy or publicity rights
3.5 Spam and Misuse
- Send unsolicited communications, advertisements, or spam
- Conduct high-volume automated messaging or calling that could be perceived as intrusive
- Gather information about others without their consent
- Use our Services for data harvesting, scraping, or crawling
- Engage in any activities that disrupt or interfere with the Services
3.6 AI-Specific Prohibitions
Develop voice assistants that:
- Impersonate specific individuals without proper authorization
- Generate deepfakes or other synthetic content intended to deceive
- Provide false or misleading information on critical matters (medical, legal, financial)
- Are designed to manipulate, deceive, or exploit vulnerable individuals
- Encourage self-harm, substance abuse, or dangerous activities
- Could be used for surveillance without proper consent
- Generate hate speech or discriminatory content
4. Voice Assistant Development Guidelines
When developing and deploying voice assistants using our Services, you must:
4.1 Transparency
- Clearly identify AI-generated voices as synthetic or AI-generated when appropriate
- Provide clear disclosure when users are interacting with an AI voice assistant
- Not mislead users about the capabilities or limitations of the voice assistant
4.2 Consent and Privacy
- Obtain appropriate consent before recording, processing, or storing voice data
- Notify users when conversations may be recorded or stored
- Implement proper data retention and deletion practises
- Use voice data only for the purposes disclosed to users
- Obtain proper consent for any secondary uses of voice data
4.3 Content and Interactions
- Implement appropriate content filters and safety measures
- Design voice assistants to respond appropriately to sensitive topics
- Not create voice assistants that deliberately provide harmful misinformation
- Respect intellectual property rights in training data and responses
- Design assistants that treat all users with respect regardless of background or identity
4.4 Safety and Responsibility
- Include safeguards for emergency situations (e.g., directing to human assistance when needed)
- Not develop voice assistants that could encourage harmful activities
- Ensure voice assistants include appropriate age verification for adult content
- Regularly review and update voice assistants to address emerging issues
- Take responsibility for the outputs and behaviours of your voice assistants
5. Resource Usage and Rate Limits
To ensure fair and consistent service quality for all users, we may impose usage limitations, including:
- API rate limits
- Processing capacity limitations
- Storage space restrictions
- Bandwidth constraints
- Number of concurrent requests
Excessive usage that negatively impacts our Services or other users may result in temporary or permanent restrictions on your account. Premium plans may offer higher usage limits than standard plans.
6. Security Requirements
You must take reasonable security measures to protect your account and any data processed through our Services, including:
- Maintaining the confidentiality of your account credentials
- Using strong, unique passwords and enabling multi-factor authentication when available
- Promptly reporting any suspected security breaches or unauthorized access
- Implementing appropriate access controls for your team members
- Regularly reviewing access logs and user activities
- Following industry best practices for security when integrating with our Services
7. Monitoring and Enforcement
VoiceCreator reserves the right to:
- Monitor and review your use of the Services for compliance with this AUP
- Investigate potential violations of this AUP
- Take appropriate action against users who violate this AUP
- Report illegal activities to appropriate law enforcement authorities
- Cooperate with law enforcement in investigations of suspected criminal violations
However, we are not obligated to actively monitor all content or use of our Services, and failure to enforce this policy in some instances does not constitute a waiver of our right to enforce it in other instances.
8. Consequences of Violations
If you violate this AUP, we may take one or more of the following actions:
- Issue a warning
- Temporarily suspend your account
- Permanently terminate your account
- Remove or block access to content that violates this AUP
- Restrict your access to certain features or capabilities
- Bill you for administrative costs and/or reactivation charges
- Pursue legal remedies, including seeking damages for violations
- Report the violation to appropriate authorities
The specific action taken will depend on the nature and severity of the violation, your history of previous violations, and other relevant factors. VoiceCreator has sole discretion in determining whether a violation has occurred and what the appropriate response should be.
9. Reporting Violations
If you become aware of any violation of this AUP, please report it to us immediately at support@voicecreator.ai. Please provide as much detail as possible to help us investigate the matter.
10. Changes to this Policy
We may update this AUP from time to time to reflect changes in our practices, technology, legal requirements, or other factors. We will notify you of any material changes by posting the updated AUP on our website and updating the "Effective Date" at the top of this policy. Your continued use of the Services after any changes to this AUP constitutes your acceptance of the revised AUP.
